Curtis made and executed for a valuable consideration a deed in fee simple to four lots in the town of Bentonville in the County and State aforesaid to wit – lots number 14, 15, 18, and 27 – to Virginia A. Curtis and to the heirs or children of her body and that said Virginia had a child there living named Brownlowe Curtis, which was then an infant. That said Virginia resided on said real estate and on a visit to her friends in Kentucky died, leaving said child her only child and heir of her body. That said child is under fourteen years of age. That said property so conveyed as aforesaid is likely to go to waste and to be involved in law suits. He therefore as a friend of and near kid thereto prays to be appointed guardian of said minor’s property as aforementioned and your petitioner will ever pray and C.
